These terms govern your use of the Cited Kitchens website and subscription service (the "Service"), provided by Cited Kitchens, a sole proprietorship ("Cited Kitchens", "we", "us"), 5540 Centerview Dr, Ste 200 PMB 283, Raleigh, NC 27606. By subscribing or using the Service, you agree to these terms.

1. The Service

Cited Kitchens delivers a weekly list, usually on Monday mornings (Eastern Time), of Wake County, North Carolina food establishments cited in public health inspection records, filtered by the vendor category you subscribe to. We currently offer four categories: pest control, cleaning, refrigeration/temperature, and food-safety manager/person in charge. Each category has a limited number of founding-rate slots; after those are taken, the standard rate applies and the number of subscribers is not limited.

2. Source data and no warranty

Lists are derived from Wake County's public open data. We are not affiliated with or endorsed by Wake County. Lists are not an official or legal record and may contain delays, omissions or errors carried over from the source or introduced in processing. For official results, consult Wake County's official website (wake.gov/food). The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including accuracy, completeness, merchantability or fitness for a particular purpose. We do not guarantee any number of leads, sales or business results.

3. Acceptable use

You may use lists only to market your own lawful services to the listed businesses. You agree to: (a) comply with all applicable laws, including the CAN-SPAM Act, the Telephone Consumer Protection Act, and state telemarketing and do-not-call rules; (b) not misrepresent yourself as a government inspector or as acting on behalf of Wake County; (c) not use lists to harass, threaten or publicly shame any business; and (d) not resell, republish or share lists outside your company. We may suspend or end access for misuse.

4. Subscriptions, billing and cancellation

Subscriptions are billed monthly in advance per category through our payment processor, Stripe, and renew automatically each month until cancelled. The price is shown at checkout. Founding-rate pricing, where offered, applies for the period stated at signup. You can cancel anytime through the customer billing portal; cancellation takes effect at the end of the current paid month, and you continue to receive lists until then. All payments are non-refundable, including for partial months, except where a refund is required by law. If a scheduled Monday list is not delivered by the end of the next business day, we will credit your account with one free week of service for that category, no claim needed; this credit is your sole remedy for a late or missed list. See our Cancellation & Refund Policy. We may change prices with at least 30 days' email notice; changes apply to the next billing period.

5. Intellectual property

The underlying public records are not owned by us. Our selection, categorization, formatting and the website are ours. Your subscription gives you a limited, non-transferable license to use lists internally for the purpose described above.

6. Limitation of liability

To the maximum extent permitted by law, Cited Kitchens will not be liable for any indirect, incidental, special, consequential or punitive damages, or lost profits, arising from the Service. Our total liability for any claim is limited to the amount you paid us in the three months before the claim.

7. Indemnity

You agree to indemnify and hold Cited Kitchens harmless from claims arising from your use of lists, including your marketing communications.

8. Governing law

These terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules. Venue for any dispute is the state or federal courts located in Wake County, North Carolina.

9. Changes

We may update these terms. We will post the new version here with a new "last updated" date and, for material changes, email active subscribers.
